PLEASE READ THE TERMS AND CONDITIONS OF THIS CONTRACT

By signing our agreement, you are confirming that you have read, understood, and agreed to the terms & conditions and cancellation policies outlined below.

Between: You (The Member) and BRIGADE FITNESS UK LTD & BRIGADE FITNESS KINGS HILL LTD (The Gym).

1.0 GENERAL

1.1 All contracts must be paid for in advance. Memberships will not be confirmed until payment has been received.

1.2 I understand there are inherent risks in participating in a programme of strenuous exercise. If I sustain or claim to sustain any injury while participating in the programme, I acknowledge that The Gym and the coaching team are not responsible – except where the injury was caused by gross negligence or by an intentional act of the coach.

1.3 I will adhere to all instructions given to me by The Gym staff.

1.4 I understand my progress is dependent upon my effort, cooperation, consistency, and adherence to the programme both inside and outside of the training sessions themselves.

1.5 I understand that opening times are subject to change and will vary from the regular schedule over holiday and Bank Holiday periods.

2.0 CONTRACT DURATION & RENEWAL

2.1 I understand that by completing payment and agreeing to this contract, I am entering into a rolling monthly membership.

2.2 I understand that my membership will be charged on a monthly basis, with the first payment being pro-rated based on the start date. After the first full payment, the membership fee will be charged monthly on the 1st of every month unless otherwise agreed. By signing this contract, you agree to the rolling monthly payment and renewal process.

2.3 I understand that I may cancel my membership at any time by providing 60 days' notice, which will be applicable after the first full payment month. The 60-day notice period will only start once a cancellation request form has been completed and submitted to The Gym. Please see section 5.0 for cancellation instructions.

2.4 You have the right to cancel your membership within 14 days of signing this agreement, provided you have not yet started using the service. After this period, the standard cancellation terms apply. Please see section 5.0 for cancellation instructions.

2.5 Should you wish to upgrade or modify your membership, please contact us at least 14 days before your next billing cycle for any required changes using the email address [email protected].

3.0 PAYMENTS

3.1 The Member agrees to pay monthly recurring fees (as appropriate for the selected membership) for each month’s membership at The Gym via recurring card payment through the Stripe payment system.

Note: This contracted membership allows attendance to either 3 group coaching sessions per week or unlimited group coaching sessions per week (depending on the membership selected), both membership options are restricted to 1 session per day at The Gym. Unused sessions do NOT carry over from week to week or billing period to billing period.

3.2 I agree to purchase a recurring membership at The Gym, which will be automatically charged to my credit/debit card every month, starting with a pro-rated payment and followed by monthly payments on the 1st of each month unless otherwise agreed.

3.3 I hereby certify that I am the holder of the credit/debit card detailed when signing up to this contract via Stripe.

3.4 If your payment becomes overdue, you will receive reminders by email and/or text. After 28 days of non-payment, we reserve the right to suspend your membership until payment is made.

4.0 MEMBERSHIP PAUSES

4.1 Membership Pauses are limited to 60 days (2 payments) per calendar year, in increments of 30-60 days only.

4.2 Membership Pause requests will only be approved if there is a medical issue that prevents The Member from attending The Gym; a doctor's note will be required as proof specifically stating that the member is unable to attend The Gym due to the medical condition.

4.3 Membership Pause requests will not be approved for holidays or periods of travel with work.

4.4 All Membership Pause requests require 28 days' notice before the next scheduled payment date. Any requests received later cannot be processed until after the next scheduled payment. A pause request form must be completed and submitted to The Gym.

4.5 To pause your membership, you must complete and submit a membership pause request form. This form can be obtained by emailing [email protected]. The pause period will only begin once the pause request form has been submitted. No pause requests will be considered until this form is received.

4.6 Upon expiration of any pause period, membership payment will automatically reactivate and resume.

4.7 If you choose to cancel your membership during the pause period, the 60-day cancellation notice period will still apply, and any payments within that period will be processed as normal and are non-refundable.

5.0 CANCELLATIONS

5.1 After the first full payment month, all membership cancellations are subject to a 60-day notice period. Any payments within this 60-day period will be processed as normal and are non-refundable. You will, of course, be able to continue at The Gym for the full 30 days after your final payment has been processed.

5.2 To cancel your membership, you must complete and submit a membership cancellation form. This form can be obtained by emailing [email protected]. The 60-day cancellation notice period will only begin once the cancellation form has been submitted. No cancellation requests will be considered until this form is received.

5.3 Memberships that are paid in full or upfront are non-refundable.

5.4 These terms are NOT flexible. If you do not intend to adhere to these terms, please do NOT sign up.

6.0 DATA PROTECTION

6.1 We will handle your personal data in accordance with our privacy policy, which is available on our website. By signing this contract, you consent to us processing your personal information for the purposes of managing your membership.

7.0 AGREEMENT

7.1 I understand that by completing the terms and conditions form, making payment, and taking up membership at The Gym, I am entering a contract and agreeing to the terms and conditions outlined above.
